When new provisions designed to help consumers deal with the growing crime of Identity Theft were added to the FCRA ( Fair Credit Reporting Act), it created the Fair and Accurate Transaction Act of 2003 (FACTA).
Some sections of FACTA became effective December 1, 2004. Other sections directed federal agencies (the Federal Trade Commission (www.ftc.gov) and the federal financial agencies) to solicit public comment and then adopt final regulations. These final regulations, called the Final Rules on Identity Theft Red Flags, or simply the Red Flag Rules, became
effective January 1st, 2008.
These rules affect virtually all businesses and make "mandatory" what previously had been "suggestions" and/or "guidelines" and give businesses until November 2008 to come into compliance. So what must businesses do??
